PROPONTIS, ON THE TWENTIETH DAY OF SEPTEMBER, IN THE YEAR OF OUR LORD TWO THOUSAND AND EIGHTEEN

IN THE NAME OF OUR LORD AND SAVIOUR JESUS CHRIST

IOANNES VII LASKARIS, FAITHFUL-IN-CHRIST EMPEROR OF THE TIBURANS, GREAT LORD OF PELASGIA, PHILISTAEA, LYCAONIA, KYPHTIC MEMPHIS, HIBERIA, HAYDIS, THE ARCHIPELAGO, NEW TIBUR, AND ALL OF SOUTHERN TIBUR, MASTER OF THE ISLES OF TEPHANON, SOLE REPRESENTATIVE OF THE HOLY, AND CONSUBSTANTIAL, AND INDIVISIBLE TRIADIC GOD ON EARTH, AUGUSTUS CAESAR, DEFENDER OF THE ONE TRUE ORTHODOX FAITH

Having considered the most grievous harms that have befallen Our Realm in recent times, and Our own role in these harms coming about, and with Our Good Christian Conscience having deeply pondered on the matter of rectifying these ills and preventing their future re-occurrence, we do hereby make the following declaration in a Decree Imperial and Sovereign, which shall be binding upon Us, and Our Heirs and Descendants to the End of Times, having Signed it in Red, and Sealed it in pure Gold.

I. The pretended power of suspending the laws and dispensing with laws by Imperial authority without consent of the Senate is illegal;

II. The levying of taxes without grant of the Senate is illegal; the declaration of states of war and peace, and the negotiation of treaties, including the authorisation of foreign military presence in the Realm, without the consent of the Senate, are all illegal;

III. Declaring martial law in peacetime without the consent of the Senate is illegal;

IV. The prosecution of the Clergymen through the Special Irregular Tribunal for Ecclesiastical Matters, and any other such committees or organs not duly sanctioned by the Senate and the Holy Synod, is illegal;

V. All subjects may keep and bear arms, under normal circumstances and consistent with the rule of law, and the seizure of such arms is illegal, unless either of the aforementioned conditions is breached;

VI. All subjects may do business as they please, under normal circumstances and consistent with the rule of law;

VII. All subjects may gather and associate peacefully and legally, for political and other ends, unless otherwise prohibited by a lawful Act of the Senate;

VIII. The Throne may not suspend or call the Senate at leisure; the Throne may only endorse that Head of Government who holds the manifest support of the majority of sitting legislators, and may not dismiss him without Senatorial consent and of his own accord before the legally proscribed term expires;

IX. Sitting Senators may not be prosecuted for political offences without the consent of the Senate; members of the Cabinet may not be prosecuted without the consent of Parliament;

X. The properties and patrimonies of subjects may not be seized or liquidated without due process and in any way contradicting the established laws and principles of the Land;

XI. Divine Right may not be cited as a reason to suspend the Constitution; the Constitution may only be amended, suspended, or otherwise altered from its normal state of standing enforcement by the Senate, given the appropriate procedures are followed;

XII. Freedom of the Press may not be suppressed without a valid Act of the Senate passed under circumstances of a National Emergency or any other Manifest Threat to the Public Order and the Security of the State; At peacetime, the Freedom of the Press may not be infringed;

Under Senatorial Act 281/2018, We were deemed to have abdicated the Throne of Southern Tibur due to flight from the Capital of the Realm, combined with attempts to “subvert and abolish” the established Religion of the State and the Highest Laws of the Land. We were thus declared "Fallen”. This Act has since been Repealed and declared Invalid by the Senate itself. However, given Our grave transgressions against the Laws of the Realm, the Great Church of Christ in Propontis, and our most loyal Subjects, we do hereby ABDICATE AND RESIGN the Imperial Throne of Propontis and all ranks and titles and honours associated with the Title of Emperor of the Tiburans. This declaration may not be rescinded. As per the Constitution and the Act of the Senate for Our Appointment, as well as in accordance with long standing Precedent, We do hereby name and nominate Our eldest Son, GRAND DESPOT ANTIPAS LASKARIS, as Our Successor. We do hereafter list Thirteen Illegal Acts which have convinced Us of the need for Our Abdication:

I. Usurping the Legislative Prerogative of the established Legislature of the Realm;

II. Prosecuting the members of the Church under charges of Heresy for political views and factional allegiances;

III. Illegally levying taxes and declaring states of war, and concluding treaties, and inviting foreign troops into the territory of the Realm;

IV. Declaring a state of Martial Law and a State of Emergency in the Realm without the consent of the Senate, and quartering military troops in cities and urban areas to enforce these states in peacetime;

V. Disarming subjects not openly inclined towards the Loyalist or Goldcoat faction, and disarming the faithful who did not ascribe to the doctrines of the High Church Clergy;

VI. Dismissing the Senate and reconstituting it with only the Loyalist members of both Houses without due process and elections;

VII. Establishing and using Irregular Tribunals, including Military Courts, to try civilian matters and political offences in peacetime, while suspending the normal courts, including the High Courts;

VIII. Suspending public trade and enforcing central economic control in peacetime, including de facto state control of the banking sector;

IX. Suspending the Constitution illegally and arbitrarily, citing divine right as a justification for assuming executive, legislative, administrative, martial and judicial powers normally entrusted into other institutions, offices and persons;

X. Prosecuting sitting Senators and Cabinet members, including the Chief Secretary of State, for political offences without Senatorial consent, and also doing so to private citizens who had broken no laws, without due process;

XI. Suppressing, censoring and controlling the press in peacetime for political purposes;

XII. Ordering death sentences to be executed on the following day of conviction and dismissing systematic appeals without a court hearing for capital and other grave offences;

XIII. Seizing and liquidating the properties and patrimonies of subjects and their descendants, without due process and contrary to established principles and laws, for political offences and perceived factional opposition;

All of which are utterly and directly contrary to the known and established Laws, Traditions, Statutes and Liberties of this Realm, including the Constitution granted to the Realm by Our very Father in the latter half of the previous century.

This Chrysoboule shall take effect a day after the public is notified of Our signing the Peace and Reconciliation Agreement at Pyrgos between the Emperor and the Senate of the Southern Tiburan Empire, at the same time that the Resignation of the Grand Logothete of the Empire shall take effect.

Having considered the most grievous harms that have befallen the Empire in recent times, and our own roles in these harms coming about, and with our Good Christian Consciences having deeply pondered on the matter of rectifying these ills and preventing their future re-occurrence, we do hereby make the following declaration in a pact in the name of the Emperor of the Tiburans and the Senate of New Tibur, to be binding upon these two Parties and their respective Successors until the End of Time.

I. The Southern Tiburan Empire is hereby declared to be defunct; the self-proclaimed Second Pelasgian Republic is declared to have never legally existed; the sole lawful successor of the Southern Tiburan Empire shall be the Pelasgian Empire, whose formation is hereby declared;

II. The Pelasgian Empire shall undertake all rights and responsibilities of the Southern Tiburan Empire at home and abroad, including its diplomatic representation, treaty obligations, alliance and international organisation membership, trade obligations, privileges, and agreements, colonial possessions, and any and all other such matters;

III. The Pelasgian Empire shall be a Constitutional Monarchy with a Parliamentary Government and a clearly established Separation of Powers; the Empire shall be a State of Laws and not of Men; Sovereignty shall be held by the Senate in the Name of the Pelasgian Nation and be incarnate in the Person of the Emperor; it shall be exercised by both through legislative, judicial and executive acts; The Empire shall never be subject to Absolutism or Tyranny of any kind;

IV. The Pelasgian Empire shall be the Nation-State of the Pelasgian People, and all Lawful Power shall be exercised for the benefit of the Pelasgian Nation; all Power in the Land derives from the Nation; the Pelasgian Nation is not created by this Act, but has existed for millennia, and far transcends the State; the State shall act as the Organ of the Nation, and not its Master; the Pelasgian Nation shall reign supreme within the borders and in all lawful territories of the Pelasgian Empire;


V. The Bank of Tiburia is hereby renamed to the Bank of Pelasgia, with the same core functions for the economy and finance of the Pelasgian Empire as it had for its predecessor; the Governor of the Bank of Tiburia shall be appointed by the Senate at the recommendation of the Minister of State responsible for the Finance Department in an impartial way; the Governor of the Bank of Pelasgia shall be wholly independent from the Executive and from any outside interference in his role, as shall be the Bank of Pelasgia itself;

VI. The Emperor shall from hence be referred to as the Basileus in both Pelasgian and any foreign tongue for official purposes; the Basileus shall be one of the Great Archons of the State, and He shall nominally hold and ceremonially exercise power over certain religious, administrative, and political functions; the Archon Basileus shall also be the incarnation of the Pelasgian Nation's Sovereignty, and he shall fulfill the following duties for the Pelasgian Nation:

1. Promulgation of amendments of the Constitution, laws, cabinet orders and treaties.
2. Convocation of the Senate and any other Legislative Bodies.
3. Dissolution of the Senate and any other Legislative Bodies.
4. Proclamation of general election for members of the Senate and any other Legislative Bodies.
5. Attestation of the appointment and dismissal of Ministers of State and other officials as provided for by law, and of full powers and credentials of Ambassadors and Ministers.
6. Attestation of general and special amnesty, commutation of punishment, reprieve, and restoration of rights.
7. Awarding of honours.
8. Attestation of instruments of ratification and other diplomatic documents as provided for by law.
9. Receiving foreign ambassadors and ministers.
10. Performance of spiritual and religious functions related to the Great Church of Christ in Propontis.
11. Performance of ceremonial functions.

VII. The Orthodox Christian Faith of the Great Church of Christ in Propontis shall continue to be the Official Religion of the Realm; The Church shall have official stewardship over the Education of the Youth and the Health of the Public, in cooperation with the relevant Ministers of State;

VIII. The Powers and Competencies of the present Emperor with regard to the active administration and the Armed Forces of the State shall be returned to the Senate; the Administrative Powers shall be exercised by the Eponymous Archon, another Great Archon of the State, at the advice of the Head of Government, as designated by the Senate; the Military Powers shall be exercised by the Polemarch, another Great Archon of the State, at the advice of the Head of Government, as designated by the Senate;

IX. All Great Archons of the State shall be appointed by the Senate; the Archon Basileus shall be cremonially appointed by a majority vote in the Senate, requiring a majority of both Nobles of the State and Hierarchs of the Church, and then ceremonially blessed by the Ecumenical Patriarch of Propontis; the Archon Basileus shall have the right to nominate His Successor, the Diadochos; before the Senate can consider any alternative candidates, the Diadochos shall have to be rejected by a majority of two thirds of the Senate's members, regardless of quorum and abstentions, including a majority of the Nobles of State and the Hierarchs of Church; this shall be regarded as an affront to the Late or Abdicating Archon Basileus, and should only be done in extreme cases;

X. All Great Archons shall serve their terms for life, unless they abdicate or are declared Fallen by the Senate; the Archon Basileus shall require the same majority needed for the Diadochos's rejection to be declared Fallen, while the other two Archons will require a simple majority; The Eponymous Archon and the Polemarch shall be appointed by a simple majority of the Senate, requiring a majority of all Nobles of the State; the latter will also require a majority of all retired Higher Officers in the Senate;

XI. The Senate shall be the supreme legislative, executive, advisory, and sovereign organ of the State; it shall nominally hold and practically exercise Sovereignty over the Empire in the Name of the Nation; it shall be composed of all hereditary and appointed Nobles, all Hierarchs of the Church, all former and sitting Cabinet Members, all former and sitting Great Archons, all former Provincial Governors and Metropolitan Mayors, all retired Diplomats above the Rank of Minister Plenipotentiary of the First Degree, all retired Officers of the Armed Forces and Security Forces holding a designated Higher Rank, all members of the Orders of Honour of the Highest Degree, all sitting and retired members of the Grand Imperial Academies, all retired Grand Praetors and Councilors of State, all former Presidents of any other Legislative Bodies of the National level, all former Colonial Governors, and all former Governors of the Bank of Pelasgia; the Presidents of any other Legislative Bodies of a National Level in the Realm may also vote in the Senate;

XII. The Senate shall have no formal parties or any other such formally declared factions of any kind; it shall act and vote as one body for the benefit, in the authority, and in the name of the Nation; the Senate shall confirm, amend, or reject the legislative acts of any lower Legislative Bodies of a National Level in the Empire; the Senate shall make policy recommendations to the Executive and set the agenda of the Legislative bodies of government; the Senate shall appoint all Justices of the High Courts at the recommendation of the Head of Government; the Senate may not introduce strictly legislative acts on its own; no body other than the Senate may pass acts with executive content in them; Senators shall serve for life, or until retirement or ejection from the Senate following a conviction for a major crime; all Senators shall hold Senatorial Immunity, and a vote of the Senate authorising their prosecution shall be necessary for them to be prosecuted for any political or other crime;

XIII. The Legislative Assembly shall be the sole National Level Legislative Body of the Empire, other than the Senate; it shall be elected by the citizens of the Empire based on an electoral law or Constitutional provision which shall always guarantee the franchise of all adult male citizens who have completed their Military Service as a minimum of franchise; the Legislative assembly shall introduce and vote on legislative acts within the agenda set by the Senate; its President shall hold a veto over any Act of the Senate, to be used in the most extreme of circumstances;

XIV. The High Courts of the Empire shall include the Grand Praetorium of Propontis and the Council of State; the Justices of these Courts, namely the Grand Praetors and the State Councilors, shall have final say of cassation, and civil disputes and judicial review, respectively; the High Courts may never overturn a legitimately enacted Act of the Senate, unless it violates any previous standing and valid Act, including the Constitution; the Empire's legal system shall continue to be structured around the Civil Law Tradition inherited from Ancient Tibur, and all the principles thereof; the Civil Code shall be modernised, a new Civil Code being published to reform and standardise the Hexabiblos of the Corpus Iuris Civilis along the Burgundian lines by the end of the year;

XV. The Head of Government and of the Executive Branch shall be the Sakellarios -or Chancellor- who shall be appointed by the Senate and who shall need to maintain the manifest support (dedilomeni) of the majority of members of the Legislative Assembly or resign; a new Sakellarios shall be appointed by the Senate every five years following a general election, at the recommendation of the new Legislative Assembly, or following an early election; the Sakellarios shall be responsible for staffing the Cabinet; he shall also be responsible for making recommendations to the Polemarch and the Eponymous Archon, including for appointments to His Imperial Majesty's Own Chancery and the Imperial General Staff; the Sakellarios's recommendations to these two Great Archons shall be binding, if explicitly stated to be so;

XVI. The Emblems of the Pelasgian Empire shall include a Coat of Arms and a National Flag which shall differ from those of both the Southern Tiburan Empire and the self-proclaimed Second Pelasgian Republic, so as to represent both factions and the Nation as a whole; various variants of the National Flag and Coat of Arms shall exist for various purposes;

XVII. Pelasgian Citizenship will be conferred by right of blood or through naturalisation, pursuant to laws which may be defined by an Act of the Senate; Pelasgian Nationality may only be conferred by descent, and shall be distinct from citizenship; citizens of Pelasgian colonies and dependencies shall be granted the status of Pelasgian Subject, but not Pelasgian citizen or national, pursuant to a law which shall be defined by an Act of the Senate; all adult male Pelasgian nationals are obliged to serve two years in the Imperial Pelasgian Armed Forces upon maturity; the status of half-breeds (gasmouloi) shall be defined by law, so as to give them a valid path to Pelasgian nationality; no mercenaries or foreigners may serve in the Armed Forces, with special exception for the Varangian Guards; all other foreigners, infidels, heretics, and mercenaries may serve in the Armed Forces under special circumstances which shall be defined by an Act of the Senate which shall need to be renewed every ten years;

XVIII. A Constituent Assembly shall be convened as soon as possible and no later than a month after this Act enters into effect to enact a Constitution including these provisions; the Assembly shall include all current Senators;

XIX. A general amnesty is granted for all religious and political offences since August 24, but not for general offences; the forces and governmental organs of the opposing sides are hereby disbanded and reorganised into the respective bodies of the Pelasgian Empire, found in Annex III; all irregulars and paramilitaries are hereby reorganised into the Imperial Pelasgian Polytofilaki; all dissenters must disband and surrender their arms within two days of the Act's day of effect;

This Act shall take effect a day after the public is notified of our signing thereof, at the same time that the Resignation of the Grand Logothete of the Empire shall take effect.
