Whereas, the Claret Sea is the home of many of the world's most refined and ancient cultures and civilisations, and the home of many developed and prosperous nations;
Whereas, the Claret Sea has long been a central route of global mercantile activity and cultural intercourse;
Whereas, the Claret Sea is characterised by a diversity of peoples, cultures, forms of governments, faiths and ideologies, and flaura and fauna unparalleled across Europe;
Whereas, the Claret Sea so far lacks a permanent forum for diplomatic dialogue and peaceful dispute resolution, as well as for economic cooperation;
And whereas, in recent memory, the Claret Sea has been the threatre of numerous conflicts and violent confrontations of a nature highly disruptive to global commerce and local peace and prosperity;
We, the States of the Claret Sea, for our own sake and for that of our common home, do hereby constitute the
Constitution of the Claret Sea Council
Character and Purpose
I. The Claret Sea Council ("CSC") is an international organisation whose purpose is to serve as a permanent diplomatic, economic and political forum for the States of the Claret Sea to discuss matters of their common regional interest, and to peacefully resolve their disputes.
Membership
II. The CSC is open to the membership of all States with a coastline touching the Claret Sea, this membership not being subject to a vote or other substantive approval procedure. All Member States ("Members") are equal and have equal voting rights, and all Members shall have the right to dispatch a delegation to the CSC.
Observers
III. States wishing to participate in the CSC without voting rights may apply for membership as Observer States ("Observers"). States without a coastline in the Claret Sea but with a significant interest in its matters may also apply for membership as Observers.
Main Organs
IV. The CSC shall have three main organs: the Standing Committee, the Secretariat, and the Dispute Resolution Tribunal;
(a) the Standing Committee shall be the permanent assembly of the delegates of all Members, and shall vote on all motions, proposals, drafts, and proposed treaties or agreements submitted before it;
(b) the Secretariat shall be the permanent body of functionaries aiding the other committees in their tasks; its membership shall come from the citizenry of the Members, and every appointment thereto shall be subject to the approval of the Standing Committee;
(c) the Dispute Resolution Tribunal ("Tribunal") shall be a body of experts to which two Members can willingly submit any dispute between them, pertaining to the Claret Sea; Observers can also submit disputes with a Member, subject to the Member's consent; two or more Observers can also submit disputes relating to the Claret Sea to the Tribunal, subject to the approval of the Standing Committee; the Tribunal shall draw its membership from the ranks of the Secretariat.
Simple Majority Voting
V. The following matters shall require a simple majority to be approved by the Standing Committee:
(a) non-binding or symbolic motions
(b) appointments to the Secretariat, excluding appointments to the Dispute Resolution Tribunal;
(c) submission of a dispute of two or more Observers to the Dispute Resolution Tribunal;
(d) any other matters or categories of matters not explicitly listed as requiring unanimity under part VI.
Unanimous Voting
VI. The following matters shall require unanimity to be approved by the Standing Committee:
(a) treaties, agreements, pacts, or binding motions and understandings binding upon the entire membership of the CSC;
(b) appointments to the Secretariat intended for the Dispute Resolution Tribunal;
(c) any amendments to the Constitution of the CSC;
(d) any sanctions under article VIII, regarding which the Member to be sanctioned shall not be allowed to vote.
Independent Agreements by Two or More Members
VII. Notwithstanding anything in article VI, any two or more Members who wish to be bound by an agreement or other instrument listed in paragraph (a) of that article may still agree to be bound by that agreement independently of the rest of the Members.
Sanctions
VIII. If a Member refuses or fails to abide by an instrument approved under article VI or a decision of the Dispute Resolution Tribunal, the Standing Committee may:
(a) impose sanctions upon the Member until such a time as the Member comes into compliance;
(b) in the case of a repeat or continuous offender, expel the Member temporarily or permanently.
Functional Provisions
IX. (a) The Provisional Headquarters ("Headquarters") of the CSC shall be the
(b) The minutes, records, registers and documents of the CSC shall be kept in the Headquarters, in the languages of all Members.
(c) The Registrar of the Secretariat shall keep a list of all Members and Observers, as well as their delegations, and shall publish all membership applications and responses thereto, with adequate reasons.
(d) Until the Members of the Standing Committee approve the first Secretariat of the CSC, an acting Secretariat shall operate the organisation.
(e) The CSC shall be constituted as a legal person of public law under the Law Relating to Legal Persons of Pubic Law (Law 194/1987) of the Pelasgian Empire. In their first meeting, the Members of the Standing Committee shall be free to reincorporate the CSC under a different law or jurisdiction. If they do not, the incorporation shall become permanent, and its amendment shall be governed by article VI(c). Notwithstanding this incorporation, the CSC shall be an international body fully independent of the Pelasgian Empire, or of any other subsequent incorporating jurisdiction.
(f) The first Meeting of the Standing Committee shall not take place later than a year after the CSC's foundation.

Constitution of the Claret Sea Council
