The Treaty of Harper’s Landing
Establishing the Association of Resolute Petroleum and Energy Exporters (ARPEE).
Preamble
We, the cosigned nations, recognize that through cooperation, global energy demands may perpetually be met and future prosperity secured. This treaty establishes the Association of Resolute Petroleum and Energy Exporters (ARPEE) to lead this global effort and ensure stability of energy markets and the prosperity of all nations.
Article I – Establishment
Section 1. This treaty formally establishes the legal entity known as the Association of Resolute Petroleum and Energy Exporters (ARPEE). By signature of this treaty, all member states will acknowledge their obligations both to and from ARPEE.
Section 2. The permanent administrative headquarters of ARPEE will be established in Harper’s Landing, Nanuka. The Republic of Nanuka will provide such facilities at no cost and further provide for any housing needs for ARPEE administrative staff.
Section 3. The duties, powers, and responsibilities of ARPEE shall take effect immediately upon ratification of this treaty.
Article II – Governing Structure
Section 1. The governing structure of ARPEE shall be divided into three bodies: the Secretariat, the Board of Governors, and the ARPEE Conference.
Section 2. All member states shall be required to provide, equally, the costs and funding of the governing needs of ARPEE.
Article III – Secretariat
Section 1. The Secretariat will provide for the day-to-day administrative and operational needs of ARPEE. The Secretariat will be charged with the administrative needs, collection of data, research needs, and the fundamental execution of the ARPEE Conference’s policy and strategic decisions. Additional duties and responsibilities to the Secretariat can be assigned by the ARPEE Conference.
Section 2. The Head of the Secretariat shall hereby be known as the Chairman. Chairmanship of the Secretariat will be established as a one-year term and it will rotate between member states. The Chairman will be nominated by the appropriate member state and must receive the confirmation of the Board of Governors. The Board of Governors has the right to reject a candidate, but cannot change the nation with which a candidate must come from. All member states shall be free to determine their own methodology for nomination of a Chairman.
Section 3. The first Chairman of ARPEE will come from the Empire of Eiffelland. Following that, the rotation order shall be: the Kingdom of Ranrike, the United Hanseatic States, the Apostolic Empire of Josepania, the Republic of Nanuka, and the Federation of Sylvania.
Section 4. Additional member states shall be added to the rotation order in the order of their admittance.
Section 5. A Chairman can be recalled by their own country’s government or impeached by the Board of Governors. A replacement Chairman must be confirmed to complete whatever remainder of the term exists.
Section 6. With the support of the Secretariat, the Board of Governors will advise member states on methodology to ensure compliance with ARPEE recommendations. The Board of Governors will also be responsible for working with member states to ensure treaty compliance and, should failure to achieve compliance be reached, proceed with expulsion proceedings.
Article IV – The Board of Governors
Section 1. The Board of Governors shall be permanently headquartered alongside the Secretariat in Harper’s Landing. The Republic of Nanuka will provide the facilities and housing needs of the Board of Governors at no cost to the member states, but not any further administrative costs.
Section 2. Each member state shall have the authority to appoint a Governor to the Board of Governors. Each member shall have one (1) appointment. Governors serve at the pleasure of their country’s government.
Section 3. The Board of Governors will work closely with the Secretariat to prepare reports, determine budgets, and ultimately create policy recommendations for the ARPEE Conference. The Board will serve as a supervisory role over the Secretariat.
Section 4. The Board of Governors shall have the power to confirm the nomination of a Chairman of the Secretariat.
Article V – The ARPEE Conference
Section 1. The highest level of governance and decision making shall fall to the ARPEE Conference, herein referred to as the Conference.
Section 2. The Conference will be comprised of each member state’s Secretary of Energy or their equivalent. Conference members will serve at the pleasure of their country’s government.
Section 3. The ARPEE Conference will be required to meet at a minimum of twice per year but can, either at their own suggestion or by unanimous vote of the Board of Governors, call additional summits.
Section 4. As the supreme governing body of ARPEE, the Conference will be responsible for coordinating the policies, strategy, and final recommendations of both the treaty and the ultimate responsibilities of member states.
Section 5. During an actual summit of the ARPEE Conference, the Chairman of the Secretariat will serve as Chairman of the Conference. This position does not carry any additional vote and is purely to guide and execute the administrative needs of the Conference.
Section 6. The First Conference will take place in the Empire of Eiffelland and subsequent Conferences will take place by vote at the prior Conference. The Conference must adhere to the same rotating schedule as the Chairmanship of the Secretariat when determining the location of the next summit.
Section 7. The Board of Governors and the Secretariat will coordinate appropriately within the confines of this treaty to execute the decisions of the Conference and advise all member states as such.
Article VI – Member State Obligations
Section 1. Adherence to ARPEE Recommendations on energy production are voluntary for all members. ARPEE will establish offices with which to assist member states, within their own unique frameworks, on how to adhere to these recommendations. Exceptions can be taken under consideration, however persistent failure to adhere to ARPEE over the course of – at minimum 3 months – can result in expulsion proceedings.
Section 2. The Board of Governors shall determine the budgetary needs of ARPEE and the responsibilities of each member state to those budgetary costs.
Article VII – Expulsion Proceedings
Section 1. The Secretariat must advise the Board of Governors that a member state has, for whatever reason, failed to adhere to ARPEE standards for a minimum of three months without prior authorization to do so. The Board of Governors will investigate the matter and should they find themselves in agreement, immediately report it to the ARPEE Conference. The ARPEE Conference will then assemble and hear the matter.
Section 2. The accused nation will have the right to defend themselves before the Conference. A 2/3 majority vote is required by the Conference for a nation to be expelled from ARPEE.
Article VIII – Membership
Section 1. The founding countries (The Empire of Eiffelland, The Kingdom of Ranrike, the United Hanseatic States, Apostolic Empire of Josepania, Republic of Nanuka, and Federation of Sylvania) shall be admitted as full members upon signature of this treaty and respective ratification process.
Section 2. Future membership is offered to all nations, provided they are a substantial energy exporter, and with the full consent of the ARPEE Conference.
Section 3. Observer and Associated Status shall be open to all nations and the obligations of such a status will be negotiated by the Board of Governors and the applicant, with final approval from the ARPEE Conference.
Section 4. Member states may terminate their own membership at will.
Article IX – Amendment
Section 1. The Board of Governors shall have the right to recommend amendments to the ARPEE Conference. The ARPEE Conference may also offer their own amendments. Only the ARPEE Conference may approve amendments.
Section 2. Final approval of amendments must be agreed to by the constitutional processes of each member state. Therefore, ARPEE cannot unilaterally alter its treaty.
Article X – Ratification and Enforcement
Section 1. This treaty shall take effect upon proper ratification in each member state’s constitutionally outlined process.
